1. Acceptance of Terms

Welcome to our AI Tools service (the "Service"). By accessing or using our Service, you agree to be bound by and comply with these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

We provide subscription-based AI tool services, including but not limited to:

2.1 AI Tool Features

  • Image Generation: Text to Image, Image to Image
  • Image Editing: Remove Background, Remove Watermark, Remove Object, Remove Text
  • Image Enhancement: AI Image Upscaler, AI Image Enhancer, AI Photo Restoration, AI Colorize
  • Creative Tools: AI Avatar Generator, AI Style Transfer, AI Hair Color Changer, AI Image Extender, AI Image Caption

2.2 Subscription Plans

  • Free Plan: 5 credits per month, 1 concurrent task, generated images with watermark
  • Basic Plan: $9.9/month (or $4.9/month if paid annually), 100 credits, 3 concurrent tasks, commercial usage rights
  • Pro Plan: $24.9/month (or $12.49/month if paid annually), 350 credits, 10 concurrent tasks, commercial usage rights

3. Account Registration and Use

3.1 Account Requirements

  • You must be at least 13 years old to use the Service
  • You must provide true, accurate, and complete information
  • You are responsible for maintaining the security and confidentiality of your account information
  • You are responsible for all activities under your account

3.2 Authentication

  • We use Google OAuth for authentication
  • You agree to allow us to access your Google account basic information (name, email, avatar)
  • You are responsible for protecting your Google account security

3.3 Account Security

  • You may not share your account with others
  • If you discover unauthorized use, please notify us immediately
  • We are not responsible for losses caused by your failure to protect account security

4. Subscriptions and Payments

4.1 Subscription Plans

  • Subscription plans are billed monthly or annually
  • Subscriptions automatically renew unless you cancel
  • You can upgrade or downgrade your subscription at any time in account settings

4.2 Payments

  • We use Stripe to process payments
  • All prices are displayed in US Dollars (USD)
  • You authorize us to automatically charge fees each billing cycle
  • If payment fails, we may suspend your service

4.3 Refund Policy

  • Free Plan: No refund required
  • Paid Plans:
    • First subscription: Full refund available within 7 days
    • Renewal subscription: No refund, but automatic renewal can be cancelled
    • Upgrade subscription: Refund calculated proportionally
    • Downgrade subscription: Refund calculated proportionally, remaining credits retained

4.4 Cancellation

  • You can cancel your subscription at any time in account settings
  • After cancellation, you can still use the service until the end of the current billing cycle
  • After cancellation, automatic renewal will not occur, but paid fees are non-refundable

5. Credit System

5.1 Credit Usage

  • Different AI tools consume different amounts of credits
  • Credits are non-transferable and non-refundable
  • Free plan credits reset monthly
  • Paid plan credits accumulate during subscription period, credits are cleared after subscription cancellation

5.2 Credit Expiration

  • Free plan credits reset monthly
  • Paid plan credits are valid during the subscription period
  • After subscription cancellation, unused credits will be cleared

6. User Content

6.1 Content You Upload

  • You retain all rights to uploaded content
  • You grant us the right to use, store, and process your content to provide the service
  • You warrant that you have the right to upload and use such content

6.2 Generated Content

  • Free Plan: Generated content includes watermark, for personal use only, not for commercial use
  • Paid Plans: Generated content has no watermark, can be used for commercial purposes
  • You are responsible for commercial use of generated content, including compliance with relevant laws and regulations

6.3 Prohibited Content

You may not upload or generate the following content:

  • Illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene content
  • Content that infringes on others' intellectual property, privacy, or other rights
  • Content containing viruses, malicious code, or other harmful technologies
  • Content used for fraud, deception, or other illegal purposes

7. Intellectual Property

7.1 Service Intellectual Property

  • The Service and all its content (including but not limited to software, design, text, graphics, logos) are our intellectual property
  • You may not copy, modify, distribute, sell, or rent the Service without our written permission

7.2 User Content Intellectual Property

  • You retain all rights to your uploaded and generated content
  • We do not claim ownership of your content

8. Usage Restrictions

8.1 Prohibited Activities

You may not:

  • Violate any applicable laws or regulations
  • Infringe on others' rights
  • Interfere with or disrupt the normal operation of the Service
  • Attempt to gain unauthorized access to the Service or related systems
  • Use automated tools (bots, crawlers, etc.) to access the Service
  • Engage in any activity that may harm the Service

8.2 Concurrent Task Limits

  • Free Plan: Maximum 1 concurrent task
  • Basic Plan: Maximum 3 concurrent tasks
  • Pro Plan: Maximum 10 concurrent tasks
  • Tasks exceeding the limit will be queued

9. Service Availability

9.1 Service Interruptions

  • We strive to maintain high availability of the Service, but do not guarantee that the Service will not be interrupted
  • We may suspend the Service for maintenance, upgrades, or other reasons
  • We are not responsible for losses caused by service interruptions

9.2 Service Changes

  • We reserve the right to modify, suspend, or terminate the Service at any time
  • We may add, modify, or remove features
  • Significant changes will be notified to users in advance

10. Disclaimer

10.1 Service Provided "As Is"

  • The Service is provided on an "as is" and "as available" basis
  • We do not guarantee that the Service will meet all your requirements
  • We do not guarantee that the Service will be error-free, uninterrupted, or secure

10.2 AI-Generated Content

  • AI-generated content may be inaccurate, incomplete, or unsuitable for your purposes
  • You are responsible for the use of AI-generated content
  • We are not responsible for the accuracy, completeness, or suitability of AI-generated content

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the total amount you paid to us in the past 12 months
  • Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you

12. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms of Service
  • Your infringement of any third party's rights
  • Content you upload or generate

13. Termination

13.1 Termination by Us

We may terminate or suspend your account for the following reasons:

  • You violate these Terms of Service
  • You do not use the Service for an extended period
  • We cease to provide the Service
  • Required by law

13.2 Termination by You

You may delete your account or cancel your subscription at any time

13.3 Consequences of Termination

  • After termination, your right to access the Service immediately ceases
  • We may delete your account and data
  • Paid fees are non-refundable (unless required by law)

14. Dispute Resolution

These Terms of Service are governed by applicable law

14.2 Dispute Resolution Method

  • First resolve through friendly negotiation
  • If negotiation fails, submit to arbitration institution for arbitration
  • Or submit to court for litigation

15. Other Terms

15.1 Entire Agreement

These Terms of Service constitute the entire agreement between you and us regarding the use of the Service

15.2 Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in effect

15.3 Waiver

Our failure to enforce any right or provision of these Terms of Service does not constitute a waiver of such right or provision

15.4 Assignment

You may not assign these Terms of Service or your account. We may assign these Terms of Service and our rights
